Terms of Use

These terms are an agreement between you and Hanson Birringer ("we", "us"), who operates Cuties: Forever Friends ("Cuties"). By using Cuties you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the app.

1. Using Cuties

Cuties turns photos of your pet into cute illustrations ("cuties"), plus montages and stickers. You need to sign in with Apple to use it. You are responsible for activity on your account.

2. Your photos

• Only upload photos you took or have the right to use.
• Photos must show a pet. Cuties is for pets, so people in a photo are left out of the illustration.
• Do not upload anything unlawful, hateful, violent, sexual, or otherwise not suitable for all ages. We check every photo and every finished cutie, and we may refuse a photo or withhold a cutie that does not pass.

You keep ownership of your photos. You give us permission to store and process them, including sending them to our service providers, only to create your cuties and run the app.

3. Your cuties

As between you and us, you may use the cuties made from your photos for any personal, non-commercial purpose, including saving, printing and sharing them. Cuties are made by an AI image model, so results vary, may not look exactly like your pet, and may resemble images made for others. Please do not use cuties to mislead people, and do not use the Cuties name or logo in a way that suggests our endorsement.

4. Free cutie, Cuties Plus and purchases

• Your first cutie is free. More cuties and montages need Cuties Plus.
• Cuties Plus is an auto-renewing subscription, billed monthly or yearly at the price shown in the app. Payment is charged to your Apple account when you confirm the purchase. It renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your iPhone's Settings › your name › Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period.
• Refunds are handled by Apple under its policies.
• Cuties Plus includes up to 5 new cuties per day. A montage uses 3 of them. We may limit repeated failed or cancelled attempts to protect the service.
• Any one-time purchases, such as themed packs, unlock the items described at purchase for your account.

5. Things you may not do

Do not misuse Cuties: no attempts to get around limits, payments or safety checks, no automated or bulk use, no reverse engineering, no interfering with the service, and no use that breaks the law or the rights of others.

6. Our service

We work to keep Cuties running well, but we may change, suspend or end features at any time. We may suspend or close accounts that break these terms. You can stop using Cuties and delete your account at any time in Settings.

7. Disclaimers

Cuties is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including that the app will be uninterrupted or error-free, or that cuties will meet your expectations.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits. Our total liability for any claim relating to Cuties is limited to the amount you paid us for Cuties in the 12 months before the claim, or US$50 if greater. Some places do not allow these limits, so they may not apply to you.

9. Apple

These terms are between you and us, not Apple. Apple is not responsible for Cuties or its content and has no obligation to provide maintenance or support. If Cuties fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, and to the maximum extent the law allows, Apple has no other warranty obligation. Apple is not responsible for any claims relating to Cuties, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Changes and governing law

We may update these terms; if we make important changes we will let you know in the app, and continuing to use Cuties means you accept them. These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules, and disputes will be heard in the courts located in New York County, New York, unless the law where you live requires otherwise.
